In a heated battle of words, the Texas Parks and Wildlife Department, led by Chairman Arch “Beaver” Aplin III, continues to face intense criticism following the unanimous decision by the park’s board on June 10 to pursue eminent domain in order to preserve Fairfield Lake State Park in East Texas.

One of the loudest opponents of this decision is Shawn Todd, the founder of Todd Interests. Todd’s company recently acquired the 5,000-acre property from Vistra Corp for over $110 million, with ambitious plans to develop a luxurious resort community worth $1 billion. The project received support from Freestone County, where the land is situated, as it promised to generate an estimated $20 million in annual tax revenue for both Freestone County and the Fairfield Independent School District.

Over the past month, public letters opposing the use of eminent domain and advocating for private landowner property rights have poured in from Todd, Freestone County Commissioners, and The Real Estate Council. However, attempts to elicit a response from Chairman Aplin have been unsuccessful.

On July 6, the Dallas Morning News published an op-ed by Aplin, who is also the owner of Buc-ee’s convenience stores, defending the use of eminent domain as the “appropriate way” to save Fairfield Lake State Park. Aplin addressed the criticism, stating that Texas Parks and Wildlife had engaged in extensive negotiations and made multiple offers to purchase the 1,800-acre park site and even the entire 5,000-acre tract from both the original owner and the real estate developer in the months leading up to the sale.

According to Aplin, an offer of $20 million plus expenses was made to buy out Todd Interests’ contract with Vistra before the closing date. However, Todd countered that offer with $30 million, which was not accepted.

In response, Todd held a news conference in Freestone County on the same day as the op-ed publication. He claimed that the board’s decision to pursue eminent domain was merely a facade, as he had received a letter from the commission two days prior, indicating their intent to condemn the land. Texas Parks and Wildlife confirmed the existence of the June 8 letter but clarified that it was part of the condemnation process and did not influence the board’s vote, as reported by the Dallas Morning News.

Aplin emphasized that despite the decision to condemn the land, Texas Parks and Wildlife remains open to reaching a deal that would save the state park and benefit all parties involved. Losing such a cherished state park would be a devastating outcome, which is why the department has gone to great lengths to preserve Fairfield Lake State Park, he wrote.

Todd recounted his initial meeting with Aplin in Dallas back in October, during his negotiations with Vistra. Aplin expressed no intention of interfering in a private business transaction but did mention that it would be “incredibly embarrassing” if the park’s department lost a park during its 100-year anniversary. Todd argued that this issue goes beyond the park or his real estate deal; it is about safeguarding private property rights. He characterized the actions of politically appointed individuals as an open and blatant abuse of power, wrongfully attempting to seize something that does not belong to them.

While Todd reportedly paid $110 million for the property, he believes its value is closer to $230 million. By invoking eminent domain, an independent appraiser will ultimately determine the property’s worth.
